By downloading, accessing, or using the App, you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the App.

1) About the App

The App provides attendance management, employee records, site management, reports (including PDF export), payments/advances tracking, and store/inventory features for organizations.

2) Eligibility & Account

  • You must be legally permitted to use the App and able to enter into a binding agreement under Indian law.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3) Your Responsibilities

You agree:

  • To provide accurate and complete information (company, sites, employees, attendance, etc.).
  • To use the App only for lawful business purposes.
  • Not to upload or store content that is illegal, infringing, harmful, or violates privacy rights.
  • To ensure you have all required permissions/consents to store employee personal data (e.g., contact details, IDs, UAN/ESIC, blood group, etc.) in the App.

4) Subscription, Fees & Payments (Razorpay)

  • Some features may require a paid subscription. Pricing, duration, and plan limits may be shown in the App.
  • Payments may be processed by third-party payment gateways (e.g., Razorpay). We do not store your card/bank details; the gateway processes payments as per its terms.
  • Taxes (if applicable) may be added.
  • Refunds/Cancellations: Payments are non-refundable unless required by applicable law.
  • If a payment fails, is reversed, or is charged back, access to paid features may be suspended or terminated.

5) Data Storage & Cloud Services

  • App data may be stored on third-party cloud services (e.g., Firebase/Firestore).
  • You are responsible for the accuracy of data entered and maintaining your own backups/exports where required.

6) Privacy

Your use of the App is also governed by our Privacy Policy. (Play Store requires a Privacy Policy link.)

7) Intellectual Property

  • The App, its code, design, logos, trademarks, and content are owned by NirvaSoft or its licensors.
  • You receive a limited, revocable, non-exclusive, non-transferable license to use the App for your internal business purposes.

8) Prohibited Use

You must not:

  • Reverse engineer, decompile, or attempt to extract source code (except where permitted by law).
  • Misuse the App to access data not belonging to you.
  • Interfere with security, integrity, or performance of the App or underlying services.
  • Use the App to violate employment/labour laws, privacy laws, or any applicable regulations.

9) Availability & Changes

  • We may modify, suspend, or discontinue any part of the App at any time.
  • We may update these Terms. Continued use after changes means you accept the updated Terms.

10) Third-Party Services

The App may integrate with third-party services (e.g., Firebase, Google Maps, Razorpay). Their terms and policies may apply. NirvaSoft is not responsible for third-party service outages or failures.

11) Disclaimer

The App is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:

  • We do not guarantee uninterrupted or error-free operation.
  • Reports and calculations are provided for convenience and may require your verification.
  • You are responsible for compliance with all labour, payroll, and statutory requirements.

12) Limitation of Liability

To the maximum extent permitted by law, NirvaSoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, business, data, or goodwill arising from your use of the App. Our total liability, if any, will not exceed the amount you paid to NirvaSoft for the App in the 3 months preceding the event giving rise to the claim.

13) Indemnity

You agree to indemnify and hold harmless NirvaSoft from claims, damages, losses, and expenses arising from:

  • Your misuse of the App,
  • Your violation of these Terms,
  • Your violation of any law or third-party rights,
  • Your content/data entered into the App.

14) Termination

We may suspend or terminate access if:

  • You violate these Terms,
  • Required fees are not paid,
  • We must do so to comply with law or protect security.

You may stop using the App at any time. Clauses that should survive termination (payments due, IP, disclaimers, liability limits, etc.) will survive.

15) Governing Law & Jurisdiction (India)

These Terms are governed by the laws of India. Courts at Nagpur, Maharashtra, India shall have exclusive jurisdiction.
